Recent Court decisions have affected two major toxic tort cases which are on-going as we start 2019:
- The judge in the Multi-District Litigation for the herbicide Roundup has ruled that there will be two phases to three bellwether trials concerning alleged dangers of exposure to this widely-used herbicide. The first phase in each case will address causation issues and the second phase will look at liability and damage issues.
- In the Flint, Michigan lead contamination of drinking water matter, an Appeals Court ruled that the City of Flint and some of its employees are not entitled to immunity in this case.
